Terms of Service

OVERVIEW

Welcome to Tokeii. The terms “we”, “us” and “our” refer to Tokeii Limited, trading as Tokeii. Tokeii Limited operates this store and website, including all related information, content, features, tools, products and services, in order to provide you with a curated shopping experience (the “Services”).

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you access or use the Services.

Please read these Terms carefully. By visiting, interacting with or using the Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not access or use the Services.

Nothing in these Terms limits or excludes any statutory consumer rights that cannot legally be limited or excluded.

SECTION 1 — ACCESS AND ACCOUNTS

By using the Services, you confirm that you are at least the age of majority in your country or region of residence, or that you have permission from a parent or legal guardian where required.

When using the Services, you may be asked to provide information including your email address, billing details, payment information and shipping address. You agree that the information you provide is accurate, current and complete and that you have the right to provide it.

You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account. You must not transfer, sell, assign or license your account to another person.

We reserve the right to suspend or terminate access to an account where we reasonably believe that it has been used fraudulently, unlawfully or in breach of these Terms.

SECTION 2 — OUR PRODUCTS

We make reasonable efforts to display and describe our products accurately. However, colours and product appearance may vary slightly depending on your device, screen settings and lighting conditions.

Because our products are made using knitted textile materials, slight variations in colour, texture, shape or measurements may occur. These variations are part of the nature of the knitted construction and do not necessarily constitute a fault.

Product descriptions, prices and availability may be updated from time to time. We may discontinue a product or reasonably limit the quantity available to purchase.

Nothing in this section affects your rights where a product is faulty, damaged or not as described.

SECTION 3 — ORDERS

When you place an order, you are making an offer to purchase the products in your basket. Your order is accepted when we send confirmation that it has been accepted or dispatched.

We reserve the right to decline or cancel an order for legitimate reasons, including suspected fraud, payment failure, pricing or inventory errors, delivery restrictions or product unavailability. If payment has already been taken for an order that we cancel, we will refund the applicable amount to the original payment method.

Please review your order carefully before submitting it. We may be unable to stop or modify an order after it has entered processing or been dispatched. This does not affect any cancellation, return or refund rights available to you under applicable law or our Return and Refund Policy.

Purchases made through the Services are intended for personal or household use and not for commercial resale.

SECTION 4 — PRICES AND BILLING

Prices, discounts and promotions may change without notice. The price charged will be the price shown at checkout when the order is placed and will be confirmed in your order confirmation.

Unless otherwise stated, prices displayed for UK customers include VAT where applicable. Shipping charges are calculated separately and displayed before payment.

For international orders, available currencies, shipping charges and any applicable duties or taxes will be displayed at checkout where available. Charges may vary according to the delivery destination.

You agree to provide accurate and complete billing and payment information. We may update or cancel an order if the information provided is inaccurate, incomplete or cannot be verified.

Promotional offers may be subject to separate terms. If separate promotional terms conflict with these Terms, the promotional terms will apply to that promotion.

SECTION 5 — SHIPPING AND DELIVERY

We currently ship within the United Kingdom and to selected international destinations.

Available delivery destinations, shipping charges and estimated delivery times are displayed on our website or at checkout based on the delivery address.

Orders are normally processed within the timeframe stated in our Shipping Policy. Delivery dates are estimates and may be affected by carrier delays, customs processing, weather, bank holidays or other circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address. Please contact us as soon as possible if you notice an error. We cannot guarantee that delivery information can be changed after an order has entered processing.

Further information is available in our Shipping Policy.

SECTION 6 — CANCELLATIONS, RETURNS AND REFUNDS

Eligible cancellations, returns and refunds are handled in accordance with our Return and Refund Policy and applicable consumer law.

Where applicable, consumers may have a legal right to cancel an online order within a specified period after delivery without providing a reason.

Nothing in these Terms or our Return and Refund Policy limits your statutory rights, including your rights where an item is faulty, damaged or not as described.

SECTION 7 — INTELLECTUAL PROPERTY

The Services and their content, including text, graphics, product designs, photographs, images, logos, trademarks, videos and website design, are owned by or licensed to Tokeii Limited and are protected by applicable intellectual property laws.

You may access and use the Services for personal, non-commercial purposes. You must not reproduce, distribute, modify, publish, sell or commercially exploit any part of the Services without our prior written permission, except where permitted by law.

“Tokeii” and associated branding may not be used in a way that suggests endorsement, partnership or affiliation without our prior written permission.

SECTION 8 — THIRD-PARTY SERVICES AND LINKS

The Services may include tools, payment services, applications or links provided by third parties, including Shopify and payment, delivery, analytics or social media providers.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for third-party websites or services that we do not own or control, although this does not affect any responsibility that cannot legally be excluded.

You should review the applicable terms and policies before using a third-party service or providing information to it.

SECTION 9 — PROHIBITED USES

You must not use the Services:

  • for unlawful, fraudulent or abusive purposes;

  • to infringe the rights of another person;

  • to submit false, misleading or malicious information;

  • to introduce viruses, malware or other harmful code;

  • to interfere with the security, availability or operation of the Services;

  • to collect or track another person’s personal information unlawfully;

  • to attempt to gain unauthorised access to the Services or related systems; or

  • in any way that breaches these Terms or applicable law.

We may restrict or terminate access to the Services where we reasonably believe that these restrictions have been breached.

SECTION 10 — ERRORS AND AVAILABILITY

Occasionally, information on the Services may contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, availability, shipping charges or delivery times.

Where permitted by law, we may correct errors, update information or cancel an affected order. If an order is cancelled after payment has been taken, we will refund the applicable amount.

We do not guarantee that the Services will always be uninterrupted or error-free. We may temporarily suspend or modify parts of the Services for maintenance, security or operational reasons.

SECTION 11 — LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or breach of statutory consumer rights.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or for business losses arising from a purchase made for personal or household use.

We are not responsible for delays or failures caused by events outside our reasonable control. Where such an event affects an order, we will take reasonable steps to minimise the effect and communicate with you where appropriate.

SECTION 12 — TERMINATION

You may stop using the Services at any time.

We may suspend or terminate your access to the Services if you materially breach these Terms, use the Services unlawfully or create a security or fraud risk.

Termination does not affect any rights, responsibilities or payment obligations that arose before termination.

SECTION 13 — SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law or removed where necessary. The remaining provisions will continue in effect.

SECTION 14 — ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy and any other policies expressly referenced, constitute the agreement between you and us regarding your use of the Services.

Any failure by us to enforce a provision of these Terms does not waive our right to enforce it later.

SECTION 15 — CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to the Services, our business practices or applicable legal and regulatory requirements.

The updated Terms will be published on this page. Where required by law, we will provide additional notice of material changes.

Your continued use of the Services after updated Terms take effect constitutes acceptance of those changes, except where applicable law requires another form of consent.

SECTION 16 — GOVERNING LAW

These Terms are governed by the laws of England and Wales.

If you are a consumer, you will continue to benefit from any mandatory protections provided by the laws of the country in which you live. Nothing in this section limits any right you may have to bring proceedings in the courts available to you under applicable consumer law.
